摘要:
医疗机构基于医疗文书的医患沟通管理模式存在重形式而轻实质的缺陷,忽视了对医方履行告知义务的流程管控。通过对《中华人民共和国民法典》《中华人民共和国基本医疗卫生与健康促进法》《医疗纠纷预防和处理条例》等相关法律条文进行分析,梳理医患沟通标准化流程,将之划分为沟通主体、沟通内容、患方决策三个模块。据此,医疗机构可以从设置工作部门、合理配备工作人员、制订管理制度等方面建立医患沟通管理机制,并按照沟通主体、时间节点、沟通内容、沟通记录以及第三方见证等路径加强医患沟通管理,以充分保障患方知情同意权,降低医疗纠纷发生风险。
Abstract:
The doctor-patient communication management mode of medical institutions based on medical documents has the defect of emphasizing form and neglecting substance, ignoring the process control of the medical party’s obligation to inform. Through the analysis of the relevant legal provisions, such as "the Civil Code", "the Basic Medical and Health Promotion Law", and "the Regulations on Prevention and Handling of Medical Disputes", the standardized process of doctor-patient communication is sorted out and divided into three modules : communication subject, communication content and patient decision-making. Accordingly, medical institutions can establish doctor-patient communication management mechanism from the aspects of setting up work department, reasonably staffing staff, formulating management systems, and strengthen the management of doctor-patient communication according to the path of communication subject, time node, communication content, communication record and third-party witness, so as to fully protect the patients’ right to informed consent and reduce the risk of medical disputes.
