摘要:
“互联网+医疗”服务模式不仅打破了传统医疗模式下医疗机构间的信息沟通壁垒，也为化解有限医疗资源与保障公民健康权之间的矛盾提供了新思路。但在“互联网+医疗”服务不断发展的过程中，其存在的监管问题也随之凸显。系统性分析了我国互联网+医疗领域存在的患者隐私权难以保障、立法滞后、监管主体及责任不明确等现实问题，针对性提出了对患者身份信息“去标识化”、严格“互联网+医疗”行业准入以及明确监管主体责任等措施，以期促进“互联网+医疗”领域健康、可持续发展。
Abstract:
The "Internet + medical" service model not only breaks the information communication barriers among medical institutions under traditional medical mode, but also provides new ideas to resolve the contradiction between the limited medical resources and guarantee of the citizens right to health. However, in the process of the continuous development of Internet + medical service, its regulatory problems also become prominent. Through the systematic analysis of the realistic problems in China's Internet + medical service, such as the difficult guarantee of patients right of privacy, lagging legislation, unclear supervision subject and responsibility,etc, targeted measures were put forward to promote the healthy and sustainable development of Internet + medical service,including the"de-identification"of patients' identity information, the strict admittance criterion for Internet + medical industry,and the explicit responsibility of supervision.
