摘要:
医疗事故罪是对医务人员严重不负责任行为最严厉的惩罚，其判例成为社会和学界关注的焦点。文章以34例医疗事故罪判例为研究对象，将违反医疗核心制度被法院判例认定为“严重不负责任”的医疗行为进行归纳 总结，发现医务人员有51类行为违反了查对制度、首诊负责制度、值班和交接班制度等12项医疗质量安全核心制度。提示医疗机构特别是基层医疗机构，应充分认识核心制度的法律意义，有效发挥司法判例教育指引作用，切 实做好核心制度建设工作，以提升医疗质量安全管理水平。
Abstract:
The crime of medical malpractice is the harshest punishment for the irresponsible behavior of medical personnel, and the precedents often become the focus of social and academic attention. The study took the cases of medical malpractice crime as the research object, and summarized the medical behaviors violating the core medical system which considered as "seriously irresponsible" by court. It was found that 51 types of behaviors violated 12 core medical quality and safety systems, including the check-up system, the first-diagnosis system, the on-duty system and the hand-over system. It was suggested that medical institutions, especially grassroots medical institutions, should fully understand the legal significance of the core system, give full play to the role of judicial precedent education and guidance, and earnestly do a good job in the construction of the core system to improve medical quality and safety management.
